Water User Associations before the Water Directorate
Geo Costa Rica provides technical and administrative assistance with establishing and managing Water User Associations (Sociedades de Usuarios de Agua, SUA) before Costa Rica's MINAE Water Directorate, particularly when several property owners or water users share a source or water supply infrastructure.
We can first assess the existing arrangements, organize information about users, properties, water sources, flow rates and infrastructure, coordinate the notarial requirements, and subsequently assist with the association's water concession.
Several property owners use the same spring or well. Should we establish a Water User Association?
A Water User Association may be an appropriate legal framework for organizing collective use of a water source, but not every shared-use situation should automatically lead to forming an association.
Who actually uses the water?
We identify the users, associated properties and how the water is currently distributed.
What water intake do they share?
It could be a spring, well, river, stream or another source whose use requires technical assessment.
Does a concession already exist?
Before establishing a new organization, it is advisable to verify the registered concession holder, authorized flow and existing records.
What is a Water User Association?
A Water User Association is a legal arrangement provided for under Costa Rica's Water Law, enabling several users to organize and collectively use public waters.
Organization of users
Establishes a structure to represent those participating in collective water use.
Shared water use
The association may apply for a water concession for its members' use, subject to the authorized conditions.
Water Directorate
The Water User Association must be registered with the registry administered by MINAE's Water Directorate.
When might a Water User Association be appropriate?
This legal framework is intended for collective water use and may be particularly relevant where several users share a source and need joint organization and representation.
How many members are required?
Costa Rica's Water Law establishes a minimum of five members to form a Water User Association; these may be landowners or tenants.
Meeting this minimum does not mean that any group of five users must automatically establish an SUA. The specific water-use situation must first be assessed.
A Water User Association is not the same as an ASADA
Although both involve water and collective organization, they have different purposes, authorities and functions.
Water User Association
Organizes members for collective use of water resources and may apply for a concession for that use.
Its registration is administered by MINAE's Water Directorate.
Community water utility
An ASADA manages a community drinking-water supply and sewerage system as a public service provider delegated by AyA.
Its institutional purpose should not be confused with the collective water-use framework of an SUA.
First we assess the water use that the association intends to organize
Geo Costa Rica can review the existing technical and administrative circumstances before coordinating the association's establishment.
A Water User Association may involve surface water or groundwater sources
Several owners use the same spring
The source, its flow, existing users, combined demand and concession history should be examined.
View River and Spring Flow MeasurementsOne well supplies several properties
We first review the well's technical and administrative status, its production capacity and any existing concession.
Existing Wells and Water UsesA shared surface-water intake exists
Available flow, source conditions and the combined demand of all members must be assessed for the specific case.
Water Resource UseThe source must be assessed against the users' combined demand
A legal organization may structure water use, but the quantity of water available still depends on the source's actual conditions.
Source
We identify where the water comes from.
Availability
We assess how much water the source can provide.
Combined demand
We integrate the members' water requirements.
Concession
The application is structured for the relevant water use.
How is a Water User Association established and registered?
The current procedure sets out distinct legal and administrative stages followed by steps associated with obtaining a water concession.
Organize users
We identify the participants and the shared water use.
Public deed
The association is constituted by public deed.
Publication
The required publication in La Gaceta is documented.
Water Directorate registration
Registration is requested in the Water Directorate's SUA Registry.
Legal entity identification
With the Water Directorate's certificate, this is processed at the National Registry.
Record books
The association has the books required by regulation legalized by the Water Directorate.
Source and demand
The information required for collective water use is compiled.
Water concession
The corresponding application is submitted to the Water Directorate.
Ongoing management
The association manages water use in accordance with the conditions granted.
Geo Costa Rica does not replace a notary
A Water User Association must be established through a public deed. This act is the responsibility of the qualified notarial professional.
Notarial documentation
The notary prepares and executes the public deed and carries out the applicable notarial acts.
Technical and administrative coordination
We organize users, properties, water source, records, water-resource and mapping information, coordinate with the notary and assist with the Water Directorate procedure.
After establishing the association, the right to use water must be obtained
A legally established Water User Association may apply for a water concession for the collective use of its members.
Association
Defines and represents the group of users.
Source
Identifies the water resource intended for use.
Demand
Combines the requirements of all members.
Concession
Authorizes water use under specified conditions.
What happens if a concession already exists or the association's needs change?
Before establishing or reorganizing a shared water use, a prior concession may exist in the name of one user or another person.
An existing concession
We review the holder, validity, source, flow and authorized use before selecting the next procedure.
Water use has changed
New members, uses, properties or requirements may call for a review of existing conditions.
Renewals and amendments
A collective concession may also require administrative procedures during its term.
Management of Existing Water ConcessionsMap of shared water use
Geo Costa Rica can map the water source, infrastructure and properties associated with collective water use together.
Elements we can integrate
- Participating properties
- Water source
- Intake
- Main pipelines
- Shared infrastructure
- Distribution points
- Users
- Relevant territorial features
View the system as a whole
Mapping helps show who uses the water, how it reaches them and what infrastructure the properties share.
It can also reveal inconsistencies between documents, infrastructure and current conditions.
What if several users already receive water but no one is sure how its use is organized?
Before discussing establishment, amendments or concessions, it is advisable to reconstruct the existing situation.
I bought a property supplied by a source managed by several neighbors. What should I check?
The physical existence of a pipe does not by itself establish which water-use rights exist or the conditions under which the property receives water.
Geo Costa Rica connects users, the source, the territory and the procedure
Our service goes beyond submitting documents. We can first organize the technical reality of water use and use that information to properly coordinate the subsequent stages.
Water User Associations in Costa Rica
What is a Water User Association?
It is a legal arrangement provided for under the Water Law to organize several users collectively using public waters. The association must be registered with MINAE's Water Directorate.
What is a Water User Association for?
It allows members sharing a water source to organize, represent their collective interests and apply for a water concession for authorized use of the source.
Who registers Water User Associations in Costa Rica?
A Water User Association is registered in the SUA Registry administered by MINAE's Water Directorate.
Can Geo Costa Rica help establish a Water User Association?
Yes. Geo Costa Rica can first assess the water use, organize technical and administrative information, coordinate with a notary and assist with registration and the subsequent water concession.
Several property owners share a spring or well. Should we establish a Water User Association?
It may be appropriate, but first the number of users, water source, shared infrastructure and any existing concession or case records should be reviewed.
Is a Water User Association the same as an ASADA?
No. An SUA organizes collective water use by its members under the Water Directorate's framework. An ASADA operates a community public water-supply and sewerage service under delegation from AyA.
How many people are needed to form a Water User Association?
The Water Law establishes a minimum of five members, who may be landowners or tenants.
Do we need a notary?
Yes. The Water Law and current regulations establish that the association must be constituted through a public deed.
Does Geo Costa Rica prepare the public deed?
No. Preparing the public deed is the notary's responsibility. Geo Costa Rica can organize water-use information and coordinate the process with the notarial professional.
Can Geo Costa Rica coordinate the notary and the administrative process?
Yes. Geo Costa Rica can coordinate the technical and administrative aspects, work with the notary and assist with registration before the Water Directorate.
Must we apply for a water concession after establishing the association?
Yes, where the purpose is collective use of the water source. Current regulations provide for submitting a subsequent water-concession application after the SUA registration and legalization stages have been completed.
Can a Water User Association hold a concession?
Yes. The Water Law expressly recognizes the ability of Water User Associations to obtain concessions for their members' use.
What if a concession is already held by one property owner?
The existing file, holder, term, source, flow and authorized use must first be reviewed. That information helps determine the proper procedure before reorganizing water use.
What if the concession is about to expire?
Its validity and current conditions must be reviewed to determine whether renewal or another procedure is appropriate before the Water Directorate.
What if all members need more water?
The new combined demand must first be compared with the source's availability. Greater demand does not automatically mean more water exists or that an increase can be authorized.
Which documents are required to establish a Water User Association?
The current procedure includes a public deed, its certified copy, the relevant publication in La Gaceta and subsequent registration, legal-entity identification and record-book formalities. Geo Costa Rica can review the case before finalizing the documentation.
Can a Water User Association manage a spring?
An SUA may organize collective use of a surface-water source, but establishing the association does not replace the water concession or any other requirements applicable to the source and requested use.
Can a Water User Association use a well?
The current legal framework covers collective groundwater use. The well's legal and technical status, capacity and corresponding concession must first be reviewed.
The next step depends on the existing water-use arrangements
A concession already exists and we need to amend it
Management of Existing Water ConcessionsDo several property owners or users share the same water source?
We can start by reviewing who uses the water, which source they share, the existing infrastructure and whether there is a previous concession or case file, before deciding how to organize water use.
Send us whatever information you already have
You do not need to arrive with an association already planned or know which procedure applies. We can begin by examining your current situation.
- Water source location
- Source type: well, spring, river or other
- Approximate number of users
- Properties involved
- Information about existing infrastructure
- Existing concession or file, if any
- Available surveys, maps or documents
