AyA Procedures

Drinking Water and Sanitation Service Availability through AyA

We assess the project's characteristics and demand, prepare the technical and spatial information needed to apply for the AyA Service Availability Certificate and interpret the institution's response to determine the next steps for development.

Assess the project Demand must reflect what is actually planned for development
Prepare the application We combine property, project, water and sanitation information
Interpret the response Favorable, negative and conditional responses require different decisions
Before designing the project

What is the AyA Service Availability Certificate?

It is the official response through which AyA specifies the existing conditions for serving a project with drinking water and, where applicable, sanitation services.

Availability establishes whether existing capacity and infrastructure can meet the water and sanitation demand associated with the proposed project.

It should therefore not be treated as a routine administrative letter. The outcome depends on location, development characteristics, number of units, projected demand and the condition of the existing system.

Water resources + infrastructure

What does AyA verify when determining availability?

The presence of water in an area does not automatically mean that a project can receive service. AyA must assess system capacity and infrastructure to meet additional demand.

Drinking water

Supply capacity

AyA assesses whether the system has enough capacity to accommodate the requested demand without compromising existing service conditions.

Sanitation

Collection and treatment

Where applicable, the availability and capacity of wastewater collection and treatment systems serving the project are also evaluated.

Infraestructura de abastecimiento de agua junto a un desarrollo residencial en Costa Rica

Water resources and infrastructure are not the same thing. A system may have sufficient water resources yet lack the infrastructure needed to deliver service to the project.

The application must reflect actual conditions

We need to understand the project before applying for availability

Service demand depends on what will be built, how many units the development will include, how it will be implemented and how it is expected to operate.

Professionals reviewing plans and characteristics of a residential development project in Costa Rica

Geo Costa Rica reviews the available information so that the application submitted to AyA is consistent with the development actually being proposed.

  • Property location and size.
  • Intended project use.
  • Number of dwellings, condominium units or other units.
  • Development phases, where applicable.
  • Estimated water demand.
  • Proposed sanitation arrangements.
  • Available site layout.
  • Relevant institutional background.
More than submitting an application

How does Geo Costa Rica support the availability application?

Our work connects project needs with the technical, spatial and institutional information required to apply for and understand service availability.

01 · Review We assess the property, project, intended use and background information.
02 · Estimate We review the demand associated with the development.
03 · Map We integrate location and relevant spatial information.
04 · Prepare We organize the documentation required for the application.
05 · Manage We submit the application to AyA and follow up on the file.
06 · Interpret We explain what the response means for the project.
07 · Evaluate We assess alternatives when availability is not favorable.
08 · Define We identify the next technical or institutional step.

Our work does not end when AyA responds. If availability is denied or conditional on infrastructure, we examine the reasons and the project's potential options.

When capacity is available

What does a favorable availability response mean?

A favorable response indicates that AyA has identified conditions under which it can meet the submitted demand, as specified in the certificate issued.

The certificate must be read together with its conditions, validity period, scope and the project characteristics used in the application.

If the project later changes in size, number of units, demand or configuration, it may be necessary to verify that the certificate still applies to the revised development.

A negative response also provides useful information

What do we do if AyA denies availability?

A negative response should not simply be treated as a “no.” First, we must understand what prevents the project from being served and whether an alternative technical approach exists.

Professionals reviewing technical and mapping information to plan the next steps of a project

Geo Costa Rica examines the institutional response to identify what is actually limiting service availability.

  • Insufficient capacity to meet demand.
  • Limitations of existing infrastructure.
  • Constraints in the sanitation system.
  • Project demand exceeding available capacity.
  • Need for construction works or system upgrades.
  • Project information that requires revision.

Depending on the findings, it may be necessary to adjust the project, assess infrastructure, consider another supply source or pursue a different institutional procedure.

When the resource exists but cannot reach the project

Available capacity and missing infrastructure are not the same thing

Some projects may be in areas where system capacity exists, but the current infrastructure cannot deliver the requested service directly.

Scenario 01

Availability exists

The system can meet demand under the conditions established by AyA.

Scenario 02

Insufficient capacity

The requested demand cannot be met under current conditions, so other alternatives must be assessed.

Scenario 03

Capacity exists, but infrastructure is missing

Water resources or treatment capacity may be available, but additional infrastructure is required to serve the project.

Technical pathway

An infrastructure-related response may require an additional stage

Depending on the conditions identified by AyA, primary works, network extensions or other infrastructure may be needed before service can eventually be provided.

Where these works require hydraulic engineering design or specific professional responsibility, Geo Costa Rica coordinates that component with a qualified professional.

Demand changes as development progresses

Availability for condominiums, subdivisions and phased developments

Real estate developments must request availability based on the project's actual scale and planned implementation.

Demand

Number of units

Demand must reflect the number and intended uses of the units included in the development.

Phases

Phased development

For projects built in phases, it is important to assess how those phases relate to demand and the availability requested.

Changes

Project modifications

Increasing the number of homes, density, intended use or demand may change the conditions under which an earlier certificate was issued.

Availability is not indefinite

Validity and extension of service availability

The certificate issued by AyA is subject to validity conditions that must be checked against the type of project and its progress.

For projects requiring months or years for design, permitting and construction, it is important to track the validity period from the date the certificate is obtained.

If the project has not reached the necessary stages, an extension should be considered in good time, subject to the institutional rules in force.

Avoiding a common misunderstanding

AyA service availability does not mean you have all permits

The certificate addresses the availability of the requested services, but does not replace other approvals required to develop or connect the project.

It is not

A construction permit

Availability does not replace municipal permits or other construction requirements.

It is not

A final service connection

Availability alone does not mean the new service connection has already been approved or installed.

It is not

Comprehensive project approval

The development must still complete all applicable environmental, sanitary, construction and land-use procedures.

It is the official response in which AyA specifies the service availability conditions for the demand associated with the submitted project.

Can Geo Costa Rica apply for service availability through AyA?

Yes. Geo Costa Rica can review the project, prepare the information, manage the application and provide technical follow-up. AyA issues the certificate.

What project information does AyA need?

The property must be properly identified and the project's use, scope and demand described, along with the information required for the corresponding application.

Does having water nearby mean my project has service availability?

No. In addition to the existence of water resources, the system must have adequate capacity and infrastructure to serve the project's demand.

Does AyA service availability also cover sanitary sewerage?

Where sanitation is included in the application, AyA must consider the existing collection and treatment conditions applicable to the property.

What should I do if AyA denies availability?

The cause must first be identified. Geo Costa Rica can review the response to determine whether capacity, infrastructure, sanitation or another factor is limiting availability and assess alternatives.

What happens if water is available but infrastructure is missing?

Works may be needed to enable service. Depending on the situation, this may involve extensions, networks or other infrastructure defined under the applicable procedure.

Does Geo Costa Rica design drinking water networks?

Geo Costa Rica assesses the territorial and technical context and can coordinate the process. Hydraulic designs requiring specific professional responsibility must be prepared by a duly qualified professional.

Does favorable availability mean I can start construction?

No. The AyA certificate does not replace construction permits, environmental approval, plan approval or other institutional project requirements.

What if I change the project after obtaining availability?

An increase in units, density, use or demand may change the conditions under which the certificate was issued and must be reviewed before proceeding.

Does AyA service availability expire?

Yes. The validity conditions established by AyA must be checked and, where applicable, an extension requested in time under the current procedure.

What if AyA is not the service provider in my area?

Availability must then be assessed with the relevant provider, such as an ASADA, municipality, ESPH or another operator. Geo Costa Rica can also help identify the appropriate procedure.
